House Passes American Clean Energy and Security Act

On June 26th, the House of Representatives narrowly passed the American Clean Energy and Security Act (“ACES”), H.R. 2454. The bill will next be considered by the Senate, with some predicting a full Senate vote held in October. Because of the significance of this bill and the material effect it will have on many sectors of the economy, we thought it would be useful to summarize the House-passed version. >>

Adam Sencenbaugh has tried more than 20 cases to jury verdict. He represents clients in general civil litigation matters in federal court, state court, the State Office of Administrative Hearings ("SOAH"), and various state administrative agencies. His cases cover a range of complex commercial litigation, including environmental litigation, trademark disputes, government contract disputes, franchise-related controversies, and general tort matters. Adam has also defended against the potential disclosure of confidential commercial information by governmental agencies under the Freedom of Information Act, Texas Public Information Act, and related state law requests. While working at Haynes and Boone, Adam served as a Volunteer Prosecutor for the City of Houston, where he prosecuted thousands of misdemeanor cases for the State of Texas. Prior to joining the firm, Adam completed a federal district court clerkship and served as an intern in the United States Attorney’s Office for the Western District of Texas in Austin.

Representative Experience

  • Won injunctive relief against Republic of Albania in federal court regarding production sharing contract on behalf of Texas-based oil and gas company.
  • Obtained set-aside of multi-million dollar default judgment taken against out-of-state commercial real estate developer.
  • Prevailed in two-week trial before the State Office of Administrative Hearings regarding protest of Class I Underground Injection Control (UIC) permit application.
  • Advised and represented clients on Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) issues in federal court.
  • Prevented disclosure of client trade secrets and confidential information for numerous clients contracting with state and federal government agencies.
  • Represented internet website publisher in multi-million dollar dispute with online advertising company.
  • Represented oil field equipment manufacturer in large scale collection matters.
  • Represented numerous clients before various state agencies, including the Texas Real Estate Commission, the Texas Department of Health and Human Services, and the Texas Board of Veterinary Medical Examiners.
