Haynes and Boone defends clients in toxic tort and property damage lawsuits. The firm has particular expertise and experience with energy companies, including refineries, chemical plants, pipelines, bulk products and exploration and production facilities.

Among the products involved in these lawsuits are various hydrocarbons, including benzene, gasoline, diesel and jet fuel as well as other chemicals and products, including methyl ethyl ketone (MEK), asbestos, creosote, silica, ammonium perchlorate and diesel exhaust and fumes.

Our toxic tort defense team works closely with environmental regulatory lawyers to ensure that we’ve identified the state and federal mandates that may provide the legal background for many toxic tort cases. We also work with the Firm’s Appellate Practice Group to identify appellate issues as soon as possible.

Our toxic tort lawyers are experts in Daubert hearings, and we have successfully excluded numerous unqualified experts and unreliable opinions.

Our lawyers have also handled a wide variety of property contamination cases, including indemnity actions arising out of contamination claims.

We generally serve as lead counsel, but we also serve as national coordinating counsel for benzene-related toxic tort litigation for one of the largest energy companies in the world. Our teamwork has helped us coordinate the efforts of litigators and appellate lawyers, inside and outside our law firm, in dealing promptly and efficiently with document organization and production, medical record gathering and assessment, expert evaluation and retention and all other aspects of litigation and trial.
