In Texas, where schools have won multiple funding rulings in recent decades, attorneys for school districts say the economic downturn is no excuse for providing too little money to schools.
"The Texas constitution imposes an affirmative obligation to provide adequate financial resources for education, whatever the economic cycle," said Mark Trachtenberg, a Houston attorney who represents more than 70 school districts that have sued the state.
